Este dossiê representa a continuidade de um projecto centrado no património dos agentes ligados à produção, circulação e recepção do livro. A partir da história e dos espólios de empresas editoriais e de coleccionadores, bibliófilos e/ou divulgadores, a introdução problematizante e os depoimentos convocam a memória dos agentes e debatem as ameaças que pendem sobre essa herança cultural riquíssima e possíveis soluções. As boas práticas de vários países impõem uma reflexão inadiável para o contexto português: que vias de cooperação inter-institucional (...) concretas para garantir o depósito, tratamento e comunica­ção duma dimensão fulcral do património e da memória colectiva. A relevância desta ques­tão deve-se a estar inextricavelmente ligada a um reconhecimento sustentável do estatuto patrimonial e histórico dos acervos dos editores e doutros agentes ligados à edição e ao livro enquanto espaços vitais para a construção da cultura impressa e para a história do livro e da edição. Background One of the biggest challenges of practicing medicine in the age of informational technology is how to conciliate the overwhelming amount of medical-scientific information with the multiple patients’ values of modern pluralistic societies. To organize and optimize the the Decision-Making Process of seriously ill patient care, we present a framework to be used by Healthcare Providers. The objective is to align Bioethics, Evidence-based Practice and Person-centered Care. Main body The framework divides the DMP into four steps, each with a (...) different but complementary focus, goal and ethical principle. Step 1 focuses exclusively on the disease, having accuracy is its ethical principle. It aims at an accurate and probabilistic estimation of prognosis, absolute risk reduction, relative risk reduction and treatments’ burdens. Step 2 focuses on the person, using empathic communication to learn about patient values and what suffering means for the patient. Emphasis is given to learning and active listening, not taking action. Thus, instead beneficence, we trust comprehension and understanding with the suffering of others and respect for others as autonomous moral agents as the ethical principles of Step 2. Step 3 focuses on the healthcare team, having the ethics of situational awareness guiding this step. The goal is, through effective teamwork, to contextualize and link rates and probabilities related to the disease to the learned patient’s values, presenting a summary of which treatments the team considers as acceptable, recommended, potentially inappropriate and futile. Finally, Step 4 focuses on provider-patient relationship, seeking shared Goals of Care, for the best and worst scenario. Through an ethics of deliberation, it aims for a consensus that could ensure that the patient’s values will be respected as well as a scientifically acceptable medical practice will be provided. In summary: accuracy, comprehension, understanding, situational awareness and deliberation would be the ethical principles guiding each step. Conclusion Hopefully, by highlighting and naming the different perspectives of knowledge needed in clinical practice, this framework will be valuable as a practical and educational tool, guiding modern medical professionals through the many challenges of providing high quality person-centered care that is both ethical and evidence based. A crise dos modelos de representação fundadas em unidades coerentes e ordenadas parece ter como um dos traços o que Bruno Latour (1993) chamou de “híbridos”(1). Os híbridos são a figura da multiplicidade que não cabe em categorias e que a modernidade “varia para baixo do tapete”. Atualmente, assistimos ao “retorno dos que nunca foram”, que interpelam de forma contundente nossas formas de vida, fortemente apoiadas na técnica. Mas como apreender os fluxos de discursos e práticas mediatizadas que nos atravessam (...) sem cair nas armadilhas do tecnicismo? Que configurações poderiam hoje assumir práticas e discursos críticos? Que agenciamentos propor? Tentar compreender o estatuto do tecnológico, do político, do artístico, do urbano e do banal como “artes do fazer” parece-nos uma tarefa urgente e necessária. Gilles Deleuze (1977), em “Kafka, por uma literatura menor” (2), deixa-nos uma importante pista, ao afirmar, em sua definição de agenciamento, que “a técnica é antes de tudo social”. A direção nos permite avançar para além das concepções instrumentalistas e dicotômicas da técnica e percebê-la enquanto processo complexo de mediação. De fato, como também afirmava Simondon (1989), os objetos técnicos sempre foram gerados por mediação e geradores de mediação(4). O presente número da Revista Logos traz justamente contribuições para fomentar esse debate e para compor o já vasto quadro das cartografias sobre tecnologia e sociabilidade no Brasil, no campo das possibilidades de mediação sociotécnica. Trata-se de um número especial, organizado dentro da parceria PPGC-Uerj e Centre d’Etudes sur l”Actuel et lê Quotidien (CEAQ) - Paris V, com a colaboração do Professor Stéphane Hugon, coordenador do GRETECH, grupo de pesquisa sobre Tecnologia e Quotidiano. Se, por um lado, o conjunto de artigos compartilha determinados referenciais teóricos, por outro, acolhe também visões próprias, forjadas a partir de diferentes experiências sociais e em distintos contextos culturais. Em comum, todos partem de certa forma da percepção de que as mediações presentes nos processos de sociabilidade podem colaborar nos processos de negociação com as regras e códigos sociais vigentes para inventar outros possíveis. Todos, de certa forma, dão a ver, em seu conjunto, que entramos numa arena onde os diversos elementos que constituem o social interagem e ganham novos contornos: o político não dialoga apenas com o “ideológico”, mas também com o cultural, o subjetivo, o artístico. Da mesma forma, a arte, por exemplo, não diz respeito apenas ao cânone, mas também ao político, ao urbano, ao sensual e ao banal. Com isso, também a noção de tecnologia se amplia e, entendida como “máquina social”, pode ajudar-nos a melhor apreender as dimensões dos fenômenos culturais e de comunicação hoje. Os onze textos reunidos neste número apontam exatamente para o momento singular em que vivemos sob alguns de seus mais diversos ângulos. Finalmente, Hedi Zamouri faz uma etnografia da Brigada Anti-Pub, movimento contra o abuso da publicidade nos espaços públicos de Paris e José Cláudio Castanheira resenha o último livro de Shetyl Turkle, “História íntima dos objetos”. O revezamento de protagonismo de um dos Três Poderes, em determinado momento histórico, é sazonal; acarretando o aperfeiçoamento de mecanismos que recomponham o equilíbrio (freios e contrapesos - checks and balances). Ocorre que a crise dos Poderes Estatais dificilmente é diagnosticada pelas próprias instituições, que se escoram no discurso de “estabilidade institucional” para evitar mudanças. A simples positivação de direitos e garantias fundamentais, também chamada por Marcelo Neves de “legislação simbólica” ou “legislação álibi”; somada à adoção de ritos meramente (...) formais nos processos pelos Três Poderes, sem que se atenha aperspectiva substancial ou à efetividade dos princípios constitucionais - identificada como “procedimentalismo” por Lênio Streck e Écio Oto Ramos Duarte - acaba por acarretar verdadeira letargia institucional. This article analyzes the issue of organizational transparency through the lens of Thomas Aquinas’ ethics. It provides moral justification for current claims about corporate transparency and sheds light on the ethical values and virtues affecting information disclosure decisions. Transparency is conceptualized as an informational mechanism necessary for performing the virtues of truthfulness, justice, and prudence. This article extends the organizational transparency and corporate social responsibility literatures by providing an alternative moral justification grounded in virtue-based theory, which extends our understanding of (...) the information disclosure decisions made by management. Cultural diversity is an inescapable reality and a concern in many businesses where it can often raise ethical questions and dilemmas. This paper aims to offer suggestions to certain problems facing managers in dealing with cultural diversity through the inspiration of Thomas Aquinas. Although he may be perceived as a voice from the distant past, we can still find in his writings helpful and original ideas and criteria. He welcomes cultural differences as a part of the perfection of the universe. (...) His systemic approach leads one to place the problem in its proper context, and to reflect on it from the perspective of virtue ethics, with a central role for practical wisdom and giving primacy to neighborly love and natural moral law. Rather than a set of rigid standards with no consideration of diversity Aquinas focuses on the common human ground, which allows for the indispensable dialogue between different positions. When dealing with practical questions, the problem is one of finding the right balance between general principle and cultural specifics, tolerance, and dialogue, always guided by practical wisdom. In this way, Aquinas’ approach is neither rigid ethical universalism with no consideration for diversity nor moral relativism with no place for any transcultural and absolute morals. (shrink)

The theme of consent is, without question, associated with the origins of bioethics and is one of its most significant paradigms that has remained controversial to the present, as is confirmed by the proposal for its debate during the last World Congress of Bioethics. Seen broadly as a compulsory minimum procedure in the field of biomedical ethics, even today it keeps open the issues that it has raised from the start: whether it is really necessary and whether it can be (...) proven to be effective. My goal will be to attempt to determine the most genuine and relevant meaning of consent, going back from its present dominant normative meaning and, from there, identifying or simply sketching other possible forms of its expression in the world we live in, so as to justify its pertinence and validity. This objective will involve three stages: (1) ‘Consent’ as a privileged paradigm of bioethics (the ethical-juridical sense), (2) The symbolic value of ‘consent’ (the social-cultural sense), and (3) ‘Consent’ as promotion of the human (the humanistic-personal sense) .It is concluded that the common notion of normative consent is not the only one, nor does it hold universal validity; that, from a historical-cultural perspective, new expressions of consent appear, adapted to different social contexts and to possibly be implemented in developing countries; and, finally, that consent is strictly indispensable in situations of extreme dependence, in its symbolic relational character, in as much as it promotes ethical relationships among strangers and ensures that they remain so. This study investigates whether employees attribute different motives to their organization's corporate social responsibility efforts and if these motives influence employee performance. Specifically, we investigate whether employees could distinguish between intrinsic and extrinsic CSR motives by surveying 229 employee–supervisor dyads from various industries , and the impact of these perceptions on in-role and extra-role performance of subordinates. We found that employee task performance increases when employees attribute both intrinsic and extrinsic motives for CSR. Moreover, when employees perceive that their organization (...) invests in a CSR practice that is both intrinsic and extrinsic, they also tend to exert extra effort in their work. The text analyses rituals as endeavours to preserve the identity of a people or a portion of a people. Rituals present or re-present the supposed common history of all the migrants. Social memory and history then tend to merge and to forget... forgetfulness is the driving force behind the writing of history. Particularly critical is the moment when the migration starts, because the need to adapt to new conditions as well as to maintain what is represented as their social identity (...) makes dual – and at times contradictory – demands on the migrants’ imagination. This paper stems from the current global worsening of the scarcity of resources for healthcare, which will deepen even more in future public emergencies. This justifies strengthening the reflection on the allocation of resources which, in addition to considering technical issues, should also involve ethical concerns. The two plans in which the allocation of resources develops—macro and micro—are then systematized, both requiring the identification of ethical criteria for the respective complex decision-making. Then, we describe how the complexity at the macro (...) level focuses on the joint consideration of the rectitude of the principles, the goodness of the ends, and the integrity—respectively the deontological, teleological, and procedural perspectives; and at the micro level, it focuses in prioritizing people, which can result in the exclusion of some, as happened with the elderly during peaks of COVID-19. The main objective of this article is to show that, in public health emergency situations, in which the daily criteria for prioritizing access to health care are not efficient, it is possible not only to ration the available means but also to rationalize them. We argue that rationing and rationalization are different concepts, entail different consequences, have different ethical foundations, and draw different guidelines for patient care. We apply them to the distribution of intensive care and vaccines to the elderly thus demonstrating the ethically legitimate domain of implementation of each of these two prioritization criteria. We conclude that rationalization respects more strictly the core ethical principles of our common morality. (shrink)

The notion of “integrity” is currently quite common and broadly recognized as complex, mostly due to its recurring and diverse application in various distinct domains such as the physical, psychic or moral, the personal or professional, that of the human being or of the totality of beings. Nevertheless, its adjectivation imprints a specific meaning, as happens in the case of “scientific integrity”. This concept has been defined mostly by via negativa, by pointing out what goes against integrity, that is, through (...) the identification of its infringements, which has also not facilitated the elaboration of an overarching and consensual code of scientific integrity. In this context, it is deemed necessary to clarify the notion of “integrity”, first etymologically, recovering the original meaning of the term, and then in a specifically conceptual way, through the identification of the various meanings with which the term can be legitimately used, particularly in the domain of scientific research and innovation. These two steps are fundamental and indispensable for a forthcoming attempt at systematizing the requirements of “scientific integrity”. (shrink)

Humans accumulate porphyrins in the body mostly during the course of porphyrias, diseases caused by defects in the enzymes of the heme biosynthesis pathway and that produce acute attacks, skin lesions and liver cancer. In contrast, some wild mammals and birds are adapted to accumulate porphyrins without injurious consequences. Here we propose viewing such physiological adaptations as potential solutions to human porphyrias, and suggest certain wild animals as models. Given the enzymatic activity and/or the patterns of porphyrin excretion and accumulation, (...) the fox squirrel, the great bustard and the Eurasian eagle owl may constitute overlooked models for different porphyrias. The Harderian gland of rodents, where large amounts of porphyrins are synthesized, presents an underexplored potential for understanding the carcinogenic/toxic effect of porphyrin accumulation. Investigating how these animals avoid porphyrin pathogenicity may complement the use of laboratory models for porphyrias and provide new insights into the treatment of these disorders. (shrink)

Why should sovereign states obey international law? What compels them to owe allegiance to a higher set of rules when each country is its own law of the land? What is the basis of their obligations to each other? Conventional wisdom suggests that countries are too different from one another culturally to follow laws out of mere loyalty to each other or a set of shared moral values. Surely, the prevailing view holds, countries act simply out of self-interest, and they (...) eventually consent to norms of international law to regulate matters of common interest.In this groundbreaking book, Fernando Tesón goes against this prevailing thought by arguing, in the Kantian tradition, that a shared respect for individual human rights underpins not just the obligation countries feel to follow international law but also international laws themselves and even the very legitimacy of nations in the eyes of the international community. Tesón, both a lawyer and a philosopher, proposes that an overlapping respect for human rights has created a moral common ground among the countries of the world; and moreover, that such an outlook is the only one that is rationally defensible. It is this common set of values rather than self-interest that ultimately provides legitimacy to international law. Using the tools of moral philosophy, Tesón analyzes the concepts of sovereignty, intervention, and national interest; the contributions of social contact theory, game theory, and feminist theory; and the puzzles of self-determination and group rights.More than simply outlining his theory, Tesón goes on to give detailed examples of international laws, international institutions, and their human rights foundations, putting his ideas to work and addressing legal reforms called for by the theory. The article deals with „The Symbolic Force of Human Rights“. Firstly, it restricts the meaning of the term „symbolic“ and of the expression „symbolic force“. Secondly, it discusses two matters: (1) a semantic matter, concerning the meaning of human rights; and (2) a pragmatic matter, related to utterance of human rights’ holders. The article emphasizes that it is not about „eternal“ rights, but rather a legal-political construction and conquest of modernity. Based on such assumptions, the author goes to the core (...) of his argument, characterizing the symbolic force of human rights as ambivalent: on one hand, it serves for the generalized affirmation and accomplishment of rights related to legal inclusion in conditions of structural dissension; on the other hand, it acts as a manner of political manipulation, whether to conceal circumstances involving lack of rights or, more abruptly, to give cause to political oppression. In this regard, the article focuses, firstly, on the symbolic force of human rights at the level of National States, and then within the international and worldwide context. Finally, the author states a brief critique concerning the rhetorical use of human rights by the nowadays’ unique superpower, the United States of America. (shrink)

The study aimed to comprehensively overview the experiences encountered by public school employees during the recruitment, selection, and placement (RSP) process within the DepEd Bohol Division. Employing a qualitative-descriptive research design, the researchers utilized a phenomenological approach to delve deeply into these experiences, shedding light on the nuances and intricacies of the division's RSP process. As Lambert et al. (2013) described, qualitative- descriptive studies aim to provide a comprehensive and detailed summary of specific events experienced by individuals or groups in (...) everyday terms. To achieve this, Colaizzi's (1978) data analysis method was applied, meticulously gathering, transcribing, and analyzing recorded participant responses. The rigorous analysis revealed that an overwhelming 81% of the participants recognized significant challenges within the current RSP system of the division, underscoring the pressing need for a renewed approach to address these identified challenges. This highlighted the necessity for an RSP policy that is responsive and innovative, tailored to meet the evolving needs and expectations of applicants, schools, and the division. By implementing improvements to the RSP process, a more efficient and timely filling of vacated and newly available positions is anticipated, contributing to the seamless functioning of the educational system and ultimately enhancing the prospects of success. This article explores Hannah Arendt's insights into the forms of social control operating especially in democracies, together with the possibility of resistance to such control. Since the way in which one defines freedom informs one's understanding of the techniques that suppress, regulate, and modify behaviour, the article begins by sketching Arendt's notion of freedom, and compares this to its liberal counterpart. That discussion leads to Arendt's conception of power, whose corollary is freedom, and whose suppression amounts to control. The institutional (...) and ideological infrastructure that accompanies the encroachment of ?the social? ? which Arendt links to the hegemony of liberalism ? is conceived as rendering the individual both powerless and apathetic. The article concludes with suggestions regarding resistance to modern forms of control, viewing Arendt's ontology as a source of tenable strategies for the deepening of democracy. (shrink)

Biomedical research has a strong impact on a country’s scientific-technological and socioeconomic development. It can make a significant contribution at three different levels: promotion of public health; the exchange of knowledge within the scientific community; and economic/ financial profitability. Africa only attracts ~3.3% of the world’s clinical research. This small proportion is due to, among several factors, the absence of two fundamental aspects: specific robust legislation and capacity for regulatory and ethical evaluation. There are five Portuguese- speaking African countries – (...) Angola, Cabo Verde, Guinea-Bissau, Mozambique and São Tomé and Príncipe. Despite presenting different degrees of clinical research development, these countries show a common serious insufficiency in the minimum conditions necessary for hosting, collaborating or leading biomedical research projects. These countries are also excluded from the support of international organisations for capacity building because of the language barrier. The Biomedical Ethics and Regulatory Capacity Building Partnership for Portuguese-Speaking African Countries project has developed methods to build capacity and partnership through research on national law, comparisons with international standards and by issuing recommendations at a national level. Through collaborative intensive training, trainees are taught to become educators at a national level. This, in turn, creates a sustainable impact at country level. BERC-Luso is a pioneering project, owing to a combination of innovative features. The partnership project: was developed exclusively in Portuguese; involves a large number of African countries, and national and international institutions; has been further enhanced by the diversity and complementarity of its action plans; and has also benefited from a broad participatory methodology based on resolution of recipients’ problems by the recipients themselves. We present an experiment designed to investigate three different mechanisms to achieve impartiality in distributive justice. We consider a first-person procedure, inspired by the Rawlsian veil of ignorance, and two third-party procedures, an involved spectator and a detached observer. First-person veiled stakeholders and involved spectators are affected by an initially unfair distribution that, in the stakeholders’ case, is to be redressed. We find substantial differences in the redressing task. Detached observers propose significantly fairer redistributions than veiled stakeholders or involved spectators. (...) Risk preferences partly explain why veiled stakeholders propose less egalitarian redistributions. Surprisingly, involved spectators, who are informed about their position in society, tend to favour stakeholders holding the same position as they do after the initial distribution. (shrink)

El autor expone las dimensiones y circunstancias de una investigación cualitativa realizada en un prestigioso instituto de docentes en Uruguay. Indagando en los rituales de interacción aplicados en el ámbito educativo, se observan los modelos de relación, la construcción de la identidad de docente y demás elementos propios de la institución educativa. En ese contexto, se identifican distintos contextos y situaciones cotidianas que reproducen procesos sociales en los que la finalidad está clara: la enseñanza y el aprendizaje.

The emigration is an arduous and complex process that includes practically all the aspects of the life of a human being. One is a sociological phenomenon: the challenging of the emigrant, the decision making, the election of the destination place, and so on; they are determined by the social issue, by the family, the friends and social networks. Normally the studies on the subject are of a quantitative type, as a matter of fact, the topic has a so deep meaning (...) and it affects so much the human being and its surroundings that seemed essential to me a qualitative approach to respond to the question: what desires, anxieties, fears and frustrations move the people to leave their homes and get themselves to a distant and practically unknown country? The war in Iraq has reignited the passionate humanitarian intervention debate. President George W. Bush surprised many observers in his second inaugural address when he promised to oppose tyranny and oppression, and this in a world not always willing or ready to join in that fight. Humanitarian intervention is again on the forefront of world politics.

O artigo tem como foco o caso da Mineradora Belo Sun e busca associar a discussão de ética nas corporações e o impacto do negócio em espaços amazônicos tendo por escopo evidenciar o desrespeito das companhias quanto às regulações internas que asseguram direitos humanos de populações tradicionais que vivem no entorno do território afetado. Deve-se prioritariamente reconhecer como consequência as violações de direitos humanos que são impostas aos grupos impactados pelos grandes empreendimentos que capturam os agentes públicos decisores dos processos (...) de licenciamento, beneficiando-se da ausência da consolidação normativa socioambiental. De modo semelhante aos rompantes etnocêntricos de uma cultura humana frente a outras, as relações entre humanos e primatas não humanos incluem um estranhamento pontuado por atração e repulsa, identificação e diferença. Ciência, arte e mitologia são a expressão viva e atualizada disso. Desde 1960, a primatologia destaca-se nesse cenário por contribuir significativamente na revisão das definições sobre o comportamento dos primatas e, consequentemente, na redefinição do humano ao apresentar a polêmica proposição de existência de "culturas" entre animais não humanos. (...) Assim, a aproximação entre humanos e primatas não humanos parece inexorável e irreversível. Isso implica, por exemplo, em cogitar se esse processo engendra, ou não, a constituição de novas alteridades a partir de um novo outro (não humano), carregado de significados. Isso incluiria, por exemplo, a reformulação de representações e de categorias de classificação, bem como o aprofundamento do debate sobre os direitos dos animais não humanos. Ao dirigir tal tipo de desafio a situações de pesquisa antropológica deve-se ter aguda consciência de que o registro etnográfico das relações entre humanos e os outros primatas será uma construção empírica, perceptual e teórica. Dado o tipo particular de relação estabelecida entre humanos e outros primatas, pautada em um universo fronteiriço de incômodas semelhanças e diferenças, constituem-se aí coletivos híbridos em que o alcance e a profundidade das interações possíveis ainda são desconhecidos. The relations between humans and non-human primates resemble the ethnocentric reaction of one human culture in relation to others, and include an estrangement marked by attraction and rejection, identification and differentiation. Art, science and myths are the vivid and updated expression of these phenomena. Since the 1960's primatology stands out in that scenario for contributing significantly to the revision of the definitions about the behavior of primates and, consequently, for the redefinition of human beings, and for making the controversial proposal of the existence of non-human animal "cultures". Then, the close connection between humans and non-human primates seems relentless and irreversible - and raises the question on whether or not these processes engender a new kind of otherness deriving from a non-human other that is full of meaning. This would include, for example, the reformulation of the representations and categories of classification, as well as deepening the debate about the rights of non-human animals. When the challenge is taken up in situations of anthropological research that address the relationships between human beings and the other primates, the ethnographic register that describes the relations between human beings and other primates will be an equally sharp empirical, perceptual and theoretical construction. Given the peculiar type of relationship established between human beings and other primates, implemented in a frontier universe of uncomfortable similarities and differences, they constituted a hybrid collective where interactions are possible but we do not know exactly how complex or how depth they are. A relação entre patroas e empregadas constitui uma privilegiada situação para a discussão sobre os conflitos de gênero e classe, uma vez que está inserida em um contexto considerado essencialmente feminino, o ambiente doméstico. Diante deste cenário, Preuss (1997) e Kofes (2001) realizaram, em diferentes épocas, estudos que exploravam esta relação. Suas pesquisam evidenciam que os conflitos gerados entre patroas e empregadas domésticas são um reflexo da disputa entre as classes pelo domínio do poder simbólico. Com base nos resultados obtidos (...) pelas autoras e utilizando o conceito de poder simbólico do teórico Pierre Bourdieu, é feito um estudo da representação das classes nas tramas das telenovelas Cheias de Charme e Avenida Brasil exibidas pela Rede Globo em diferentes horários no ano de 2012. This research tackled the challenges public secondary schools in Sagbayan District, Bohol, faced regarding records management. The study employed a mixed research design, combining both descriptive-qualitative and descriptive- quantitative methods. The qualitative phase involved conducting in-depth interviews and focus group discussions with relevant stakeholders involved in records management. On the other hand, the quantitative phase utilized survey questionnaires to gather data from relevant stakeholders to determine the acceptability of the proposed MIS among end-users. The first phase findings revealed various challenges (...) in records management faced by the schools, such as inefficient manual record-keeping systems, difficulties in data retrieval, and the risk of data loss due to inadequate backup procedures. These challenges highlighted the need for a comprehensive, technology-driven solution to streamline records management processes and ensure data security. The evaluation results in the second phase showed that the developed Management Information System (MIS) was well-accepted among the end users. The absence of any significant difference in the level of acceptability among the participants further validated the system's suitability for addressing their specific needs. The successful implementation of the MIS proved to be an effective solution to the records management challenges faced by the public secondary schools in Sagbayan District, Bohol. (shrink)

Abstract The article addresses three aspects of the humanitarian intervention doctrine. It argues, first, that the value of sovereignty rests on the justified social processes of the target state ? the horizontal contract. Foreign interventions, even when otherwise justified, must respect the horizontal contract. In contrast, morally objectionable social processes (such as the subjection of women) are not protected by sovereignty (intervention, of course, may be banned for other reasons). In addition, tyrants have no moral protection against interventions directed at (...) them. Second, the article addresses the internal legitimacy of humanitarian intervention. It concludes that the liberal state may only use voluntary soldiers (either the voluntary army or mercenaries) to conduct humanitarian intervention. Conscription for that purpose is not permissible. The article shows that the long-standing criticism of mercenaries stems from a romantic prejudice and is thus unfair. Third, the article makes a distinction between intention (the determination to perform an action) and motive (a further goal that the agent seeks with that action) and shows that only intention is relevant for humanitarian intervention. A justified humanitarian intervention requires the intention to liberate the victims, but not necessarily a good further motive. It shows how mainstream doctrine has impermissibly confused the two concepts. (shrink)
